I'm a USMC veteran residing in the state of California. My wife served me the Petition requesting for Dissolution of Marriage along with form MC-150 Declaration Under Uniform Child Custody Jurisdiction and Enforcement Act (UCCJEA). My question is what exactly is the purpose of form MC-150 because it indicate that Declarant's present address is not disclosed and confidential. However, the address indicated on the form is her present address. Is there another party involved in this case and where can find more info regarding this matter? please help

My response:

The purpose is to assure that California maintains jurisdiction over the Custody issues of your children until they are age 18, no matter what other State or Federal laws may become involved; i.e., that no matter what other State may otherwise obtain jurisdiction due to residency in that other State, California will always have primary jurisdiction and enforcement rights.

Apparently, your wife has filed these papers on her own behalf - - she doesn't have an attorney, and that's why it's her name at the top left of the form.

You can find much more information about this form, and the Uniform Child Custody Jurisdiction and Enforcement Act itself, by going to your local college law library to read all about it.
