Michigan - Arrested for OPERATING WHILE INTOXICATED. I now have an arraignment date of Feb 28 and need more time to find a lawyer. Does anyone know the name and form number I need to request a postponement? 88th judicial district court.

Why do you assume there is a form for everything?

You don't need a lawyer for the arraignment. In Mn they will ask you if you can afford a lawyer, read the charges against you and ask you to plea guilty or innocent. If you tell them you need more time, the Judge will automatically enter a not guilty plea for you.

When you arrive in court for your arraignment, check in with the court clerk and s/he will direct you to a courtroom where the judge will ask you some questions and tell you the charges against you and the possible penalties. The judge will ask you how you plead.

If you do not have an attorney with you to advise otherwise, plead "not guilty" and another hearing will be scheduled.

Between your arraignment and the subsequent hearing, you should have enough time to find an attorney in the Alpena area to represent you. In fact, I am surprised you believe you will be unable to locate an attorney in your area before the arraignment.

Good luck, mpb329.
