Former Employer knows my husband needs the $$$ and won't give him his pay check

last Friday my husband called his now former employer to find out when he could pick up his paycheck. The employer asked why so my husband told him we were out of diapers for our 1 and 2 year old children. his boss said he would not give him the pay check until 5 pm. at that time my husband asked what should we do we have no diapers. he said it was not his problem he could not have his pay until 5. the call was disconnected and my husband got upset. the employer called right back claiming my husband had hung up on him and was angry. i tried to reason with him and again explained the situation and he started yelling at me. i told him id rather not have this escilate into a yelling match. at this he said you won't yell at me b****h, i'll mail it out and you won't get it until monday. at this i told him my husband would be there at 5 to pick up his paycheck. about 1 hour later he called and said he mailed it and we would have to wait. here it is tuesday evening and my bills have gone past due not to mention we had to take the money out of our checking account for diapers leaving $4.05 in it so i am fearing checks will bounce. here's what i need to know.

1. do i have a case?
2. can i sue if checks bounce
3. can i sue for mental anguish
4. can i sue for the pain and suffering of my children

well for one, if your husband could've gotten there to pick up his paycheck then the boss didn't have to mail it. you cannot sue for mental anguish and the children's pain and suffering; and more than likely you won't be able to sue for the bills boucing. other than that call a lawyer and get some info from them.

Was he fired or did he quit? Makes a difference as to when the last check is required to be paid out. How often was he normally paid? Might make a difference too.

The state of Ohio does not have any statute requiring an employer to release a final paycheck at any particular time.
