My husband and I own a two unit building with his brother and sister-in-law. They are getting a divorse and the sister in law lives in the top unit her husband has been ordered to pay all bills until the divorse is final. He has fallen behind on payments, making it very hard on my husband and I. can we get a partition to divide the property, and give them their equity and take over the building? There is one mortgage and the sister-in-law is not on it, if she finds someway to pay their half can we refuse and do the partition?
