What is the name of your state? NJ

I am a franchisee with a large retail chain. Recently this chain started discounting merchendise at their corporate stores at prices lower than the franchisee wholesale costs. If we do not participate in the sale we lose all our customers to the corporate stores, if we do participate we lose money when we sell the merchendise. This franchisor already settled a class action lawsuit for action very similar to this, which they forced a lot of franchisee's out of business. Since I opted out of the first class action lawsuit settlement is it possible to initiate another?
