The Small Claims Court ruled in my favor that a pivate party in a used car sale misrepresented the condition of the car and failed to disclose its salvaga title. The defendant did not appear. Before I filed the small claims suit, I parked the car in his driveway and gave the keys to his cousin. I never received delivery of the title which the seller was holding until my check cleared. He actually cashed the check the following day. I have been unable to contact the defendant since I filed the suit. If he sold the car while I waited for the court date and he has not voluntarily returned my money, has he committed a criminal offense and if so how do I initiate the proceedings?
