My husband and I were in an accident in Wyoming, we live in Texas.

When we called to file the claim, the insurance company on our insurance card did not have a record of us in the computer. Advised us to call the Agency, to make a long story short, the Agency has not only been taking customer down payments and cashing the checks, they are never submitting ppwk to the insurance company. I called the Insurance Commissioner who contacted the insurance company and they started the claim process. They asked me to provide proof of pymt, well all I could prove was the initial pymt as the 2 subsequent checks were never presented.

I have been told that I am entitled to 2500 per person if the agency does not provide proof of acceptance or waiver of the PIP coverage. Is this true? Please help, did I mention tomorrow is 2 weeks since the wreck and I still do not have an offer.
