What is the name of your state (only U.S. law)? ga.
as i previously posted, i had to withdraw from my ch 13 due to an 18,000 lawsuit settlement that we received 2 years ago. (after making 33 of 36 on time payments). or pay the trustee 18k which we didn't have, and never get a discharge. on july 1 it was withdrawn and it was dismissed. i understand that i cannot file ch 7 for at least 180 days from the date of the withdrawl. since we were unable to complete the ch 13, we need to get all of the remaining debt discharged in the ch 7, otherwise, we'll be back fighting off creditors again.
my question is.... will my house be exempt from the ch 7 when i file? we have a living trust and the house is in the trust. we used to have about 35k in equity, but since the housing market has dropped, we may only have 15-20k in equity. the market has really taken a beating and it's still dropping.
thanking you in advance,
