I have been on WC from a work related injury to my right knee. I had torn my right knee meniscus. It's been over a year now and I have already seen 4 orthopedic docs. the last doc told me that my knee was so severely gone that even arthrosopic surgery wasn't going to help. he told me at this point looking at my current x-rays that I need a total knee replacement. He went on to tell me that until I can't stand the pain and I can't get out of bed etc. Then I can have the total knee replacement, but he doesn't recommend it now because I'm too young (51). I have been on limited duty at my workplace since last year June. Recently I got into an confrontation with my boss about me parking in the handicap stall. i have a disability placid card hanging from my mirror in my car and a doc note stating for me to park near the building within 30 feet.My boss was really rude too me and made me feel really bad. It was like he was harrassing me and just pulling me into the office making a big deal about me parking in the handicap stall. He told me I'm a employee and I'm not to park there and to park behind the building were no one can see my car. Now, I feel so uncomfortible working there and my attorney already told me to not get myself fired in anyway or i could loose my case. Is there anything I can do? I just not feel happy working at my job anymore.

Yep. You can quit.... or follow your attorneys advice.

Thank you for replying, but what does your quote really mean? I think it may mean that I should quit before my boss really fires me? I'm not sure what your quote really means?
I'm afraid I will loose my mind. My boss has already cut hours due to the economy. I have another job that I'm much happier at. Do you think my boss is being discrimitive towards me. My boss parks in the handicap stall everyday, and his not handicap.:confused.

It 'means' exactly what it says.... you can do whatever you want and ignore your boss's 'order' and get terminated or you can follow your attorneys advice "to not get myself fired in anyway or i could loose my case."

Not relevant. RHIP = Rank Has Its Privileges. When you own your own company and lease a building and parking lot, you can park where YOU want.

Thank you for being clear to me and to the point! This company is a Car Rental Company and my boss does not own it. but, I have been taking pictures everyday and the handicap stall is taking up by my boss and other company vehicles that should not be parked there. To me is why can't he park elsewhere too and make sure that no one else and company vehicles can't park there too. The company has a huge lot and it just seems not fair or right of my boss to just tell me to move my car and he parks in the handicap stall. Isn't it a Federal law/violation for vehicles without an handicap placid card to be parked in the handicap stall? I have been taking pictures of even other employee's parking in those stall everyday along with my boss. Can I file something against him, because at times there will be nowhere near the building entrance that I can park. I do have a doctors note stating this for me to do. I feel as though I have to listen to my boss rather then my doctor. I feel really scared to just park in the stall and then my boss terminated me. What can my attorney do if this was to happen?

Being that this is private property, the police may or may not come out and do something about your boss being parked illegally. I live in an apartment complex. I myself have a handicap placard and my apartment complex has given me a specific space in which to park, with the handicap marking in the space as well as the signage stating there is a fine if parked there without the handicap placard. There have been people that will park in the space that do not have a handicap placard. I have called the police at the direction of the Manager of the apartment complex. Some of the officers have given tickets and some have said they can't do anything (they don't want to do the paperwork is what that amounts to). Most officers will help though.

So, you can call the police to come out and he'll get a ticket. In my state, the ticket starts at 60.00. If it is not paid, a bench warrant is put out for the person and the fine then goes to 500.00.

I'm sorry you are having a hard time with your employer. I know it is rough!!! Been there....there right now in fact .
