What is the name of your state (only U.S. law)? Hawaii, My son applied for a job at my workplace this past March 13th. The GM at that time hired him and my son had filled out all the paper work, turned in his drivers abstract and did the drug testing as well. Suddenly, there was a new GM that transferred into the company. to make a long story short. The new GM played yoyo tag with my son and he can't seem to find all my sons paperwork. My son has been waiting to start his job with the company, but it seems that its just not happening with this new GM. My son is now worried that his paper work he filled out has all his identity info about him. No one can tell him exactly what happened to it. I have spoken to the payroll accountant and she remembers seeing it and also the Supervisor saw his papers too after the former GM left on personal leave. What can my son do to fix this with the company?:confused:

The company is not legally obliged to hire your son just because a now-absent GM indicated he might be hired. As far as your son's personal information is concerned, he doesn't have a case against the company for not knowing where it is. Your son might have a case if his personal information is ever used in a way that damages him, however he will have to wait for that to actually happen before he has any legal recourse.

Assuming the company is still interested in hiring him, he can offer to repeat all the pre-employment steps. If they've changed their minds about hiring him however, there's nothing he can do about that.

You should know the answer to this query. Its nothing. He should look for work elsewhere & if they get it right and say "come-on-down" he should re-evaluate his opinion of the company and decide if he wants to go to work for them or not.

I want to thanx u all for your reply. I really feel better especially with Georgel1776 reply. I believe my son is going with Georgel1776. My son just didn't like the run around from the New GM. My son just wanted a yes or no if he was going to be hired or not. My son will just have to wait and see if someone uses his identity in the future.

This is a legal site. You asked if your son had any legal recourse for the runaround he's getting. George1776 did not answer your question.
