What is the name of your state (only U.S. law)? NJ
We have used day care for the full year (from Jan 2014 to Dec 2014). We have around $4,000 in our Dependent care account for 2014. Since we pay around $1000, we chose any four month to submit a claim.
Our claims were denied and reason was the dates used on the claim were after termination of employment (august 2014).
We are replying to the denial letter with adjustment of dates and new receipts. We have 60 days to reply from the date receival of denial letter.
We are being told that since our response is coming after run off date (April 2015) and they are considering it as a new claim, Horizon FSA team will be rejecting the claim.
My argument is, it’s not a new claim rather a rectification of previous claim which was submitted before run off date. I didn’t know that service dates after termination can’t be used.
Do you think we have any legal rights against the decision?
