Our work benefits run june-june. I had an FSA that had an over payment of $191.45. I made the stupid mistake of paying an old Dr bill , not realizing I cant do this, I have zero issue with paying this money back. However they froze my account and i still had an available balance of $645.96 . If i paid back the overpayment I would have had an available balance of $837.41. Every single penny of that was already taken out of my paycheck every week. We did have rollover for unused amounts into the next year,

My dilemma is this, The company I worked for was sold and now the new company uses a different company for the FSA.

Where is the money i paid into this account? Why cant i have access to it if i already paid for it? I called the number on the back of the card and they told me my account was closed in may 2016 and there is nothing I can do. At the end of the day I feel like 654.96 was taken from me as I did pay this all back. I do feel like I owe the 191 because i did pay a debt that was old and not allowable, Thats not up for dispute.Do I have a recourse a year later to get any of this money back?? The reason it has taken so long to address this issue is because they just contacted me 3 months ago about the over payment.I have been trying to deal with our MY HR the rest of the time regarding this with no substantial answers.

Where is the money i paid into this account?

This long after the fact, probably forfeit. But the only one who can tell you for certain is the company that handled your FSA before your employer was sold. They will still have your records from the time your former employer had an account with them.

You probably just needed to send in receipts showing that amount of allowable expenses accrued to correct the account and get access to the rest of the funds. But you would have had to do it, and use the remaining funds, by the end of that plan year or the grace period after. So if the plan year ended in June 2016, it is long past when you could have done anything. FSA is use it or lose it.
