fudge income is this illegale???

What is the name of your state?ky. I just received a phone call from a collection agency asking for the amount due on my card which is 13000.00. He preceeded to give me advice ask freinds relatives etc. I have no where to turn for money. Here is the kicker,he had just pulled a credit report on me and told me it looked good except for this one card and that I should go online and apply for a credit card but I must "fudge" my income and then use that credit card to pay for this collection. OH he offered a 70% settelment if I acted in 20 days. Is this legal or can I sue this collection service along with the creditor for suggesting to commit fraud.

The 'fudge' income is also pretty typical of the lowlife jerks they have working in the CA industry. It WOULD be fraud (though people do it all the time) but I doubt you can sue them for suggesting it.

Their threats of 'pay in xx days or else' are also typical and also crap, ignore it. They have quotas to meet each month so of course they want to give you a deadline. The 70% is not a good deal either, not even close.

How old is the debt, when did you last pay the original creditor ??

I had the card for ten years and have not made a payment in 6 mo. they told me it was charged off. This is a collection service that the bank hired. I hope I answered your question. Thank you for your quick response

So, its a new charge-off, that explains the 70% offer - still not a good offer. If this is not a huge debt, and if you can stand the collection agencies calling you, they may come down quite a bit more or be willing to settle for 35-50% once it has a little age on it. These guys are the first CA in line - could even still be just internal collections for the creditor. If you can't pay it, don't bother talking to them, its a waste of time and not worth raising your blood pressure over. Let 'em talk to your answering machine.

Ouch, 13K is pretty big. B1 will be pretty aggressive and for 13K they are likely to sue you - but that probably won't happen for a while yet. KY has a 5 years statute of limitations on credit card debt so they have lots of time to file a lawsuit.
