Full time to Part Time

What is the name of your state? Fl
I was hired on as a full time employee last January and have now been asked to go part time.
I honesty cannot afford to go part time, and have been looking for another job while I am at home in the evenings but no luck.
Is it true that if I ask tell them that I cannot afford part time, they can lay me off so I can at least collect unemployment til I find another full time job?

If you ask them to lay you off because you cannot afford part time, they MAY, if they so choose, do so. The law does NOT require them to. It is entirely up to them.

Keep in mind that unemployment is going to be only a fraction of what you are currently earning. You may well get more working part time than you will on unemployment.

I think, though, that ecmst12 makes a good point. If the employee stays on at part time, there is a reasonable chance, in my experience, that she may qualify for partial UI. But if she asks to be laid off, she may not even qualify at all since it could be seen as a quit. The employer, frankly, would be a fool to agree to lay the poster off and thus make themselves vulnerable to a UI claim. I wouldn't do it. If I had work for her, even if it was only part time work instead of full time, why should I take responsibility for her unemployment claim, and then have to hire a part time worker to do her job?
 
Full to Part Time

I live in Fl

I work in the construction inudstry and as everyone is all aware there is a big slow down now and alot of people are geting laid off.
I have a really great boss and she did not want to put me to part time and to say the least she has been more than awesome in keeping alot of people working when there isnt any work.
Or should I say "very little work".
I have been sending out my resume' for a few weeks now and really no good bites because I am quite versed in construction and not to much in anything else.
I know I can work in any office and learn something new but no one is really hiring.
I didnt ask to be laid off, I was speaking to someone who said that if I was hired at full time and now I am asked to go to part time thats a big income difference for myself and family.
He said that if they cant keep me full time, and I cannot afford to go to part time there only other option is to lay me off. Yes I would go to unemployment to fill the gap.
But quite frankly I pay into that fund and have for a long long time and think thats why it is there.
To get over the gap til I find a new full time job.
Any advice would be appreciated.

Well, actually, no. YOU do not pay into that fund at all. There is no deduction taken from your wages to pay unemployment. Your employer pays 100% of it.

If "someone" told you that if you ask to be laid off the employer has to do it, they were wrong. If "someone" told you that if you ask to be laid off you are guaranteed to get unemployment, they were wrong.

Unemployment is ONLY for when you lose your job through no fault of your own and for reasons attributable to your employer.

If you work part time you may be eligible to collect partial unemployment.

If you ASK to be laid off and your employer does so, there is NO guarantee that you will be able to collect.
