We believe Pennsylvania is a so-called "add-on" type of no-fault state. This means that your daughter can file a liability claim against the resposible party or their auto insurance company. However, you should check the policy for the auto your daughter was driving, and see if they have a right of reimbursement or if the responsible party gets an offset for the amount paid by your daughter's coverage. Your daughter should consult with a personal injury lawyer in Pennsylvania to determine hrer full rights and responsibilities. The initial consultation should be free.
