My daughter was terminated from a job after 2 yrs when a "customer" reported her for using profanity in front of her child. She was told by her employer that store video showed the "customer" coming through her line. The next day, my daughter learned from other employees that the "customer" was in fact her ex-boyfriend's sister-in-law (who doesn't like my daugter) and that 3 of his other family members, who are employed there as well, were bragging about getting her fired and telling everyone that they were going to report it to the home office to keep her from being employed in another store. My daughter is certain that this girl did not come through her line but was indeed 2 isles away but her employer refused to let her view the video. I don't think she has any recourse against her former employer but can she take any action against the "customer" if she can prove that she lied to get her fired?

I understand regarding her employer, but can the "customer" be held responsible if my daugther can prove that she lied. My daughter has not only lost wages but her insurance coverage, etc.

Sure, if you're willing to give your Daughter about $10,000 to hire an attorney and find witnesses, get statements, show intent and IF and only if the defendent has the funds or assets to pay monitary damages.

Listen. You MIGHT prove the girl made false accusations againt your daughter. you might even prove she lost her job over it.

but what you won't be able to prove is that your daughter has any monetary damages. She can find another job. The fact that she hasn't yet isn't the point.

Teach her to move on. Not to spend her time worrying about idiots who enjoy causing misery. She'll end up losing in the longrun.

Or are you doing this not for her but for you?

I would consider loss of wages monetary damages and I do this because we are good, honest people and I believe in justice, whatever the cost. Good thing my sister-in-law is an attorney who happens to be out of town!!
