I bought my home in June 2004 from US Bank, it was a repo. Before the closing date the neighbors were in the middle of building a fence and I told them I didn't agree with it because it encroached on my soon-to-be property. They told me they could build it where they wanted because I didn't own it yet and when I moved in they had finished the fence. They never had permission from the bank to take down the old fence but they claim that they had permission from the owner before the bank. One third of the fence is in the same line as the old fence which was on my property to begin with, 2/3 of the fence is completely new fence-line. The old fence curved back into the side of my house and the right side was facing into my property. I have pictures of the old fence. When I moved in they had also taken out the portion of my fence that led back to my house. For my own assurance, I obtained an old survey from a house down the block and had a surveyor friend of mine come measure and mark what he believed the property lines to be. The neighbors took advantage of the time the house was vacant to do what they wanted, they even planted a tree on my side of the fence so it would give them more privacy without taking up space in their flower bed (they told me about the tree like they did me some big favor). They also have an arbor over their driveway and I believe one of the main support posts is on my property. If I paid the $1500 to have an official survey done and it confirmed that the neighbor built the fence and part of the arbor on my property could I remove it?

sorry, only the court can order them to remove it.All money you paid out is listed in the complaint,and asked as restitution .Go get a lawyer they will have to pay for that too.
Do NOT touch it yourself.That could be considered criminal damage to property.
