Furniture Purchase - what can we do?
Illinois - Having purchased and paid for a set of furniture from a franchised store of an independently owned company, it came with several marks over the fabric. It was unsuccessfully cleaned by the manufacturer and they decided to replace it. The replacement set also had marks but was cleaned successfully and was recently due to be delivered to us. The whole situation to this point has gone on for over 6 months and we did not get what we felt was adequate service both in the timeframe and the way we were treated. We then seeked some sort of compensation due to this. At this point the store offered what we considered an unacceptable amount of compensation from the manufacturer, or a full refund (we do not want a refund but want the furniture). We decided to call the corporate offices regarding the service we received (are currently waiting a reply). The store has since refused delivery of our replacement furniture, refuses to speak to us and refuses to have us as customers. They say they will only refund us and will not give us the replacement furniture and that they are legally entitled to do this. We have the original damaged furniture which we will be giving back.
Do we have any consumer right to be able to receive the furniture or are they correct in that they can decide they do not want us as customers, and refuse to give us the furniture we have paid for, even though they have our money and the replacement furniture? Is this discrimination in any way?
