Ga. Relocation!!!!

What is the name of your state (only U.S. law)? Georgia
The DD states (mother can not move more than 50 miles from my home if so it materialy effects the best intrest and welfare of the kids). She wants to moving for family support . She gave me a letter that she and my kids were moving (1200 miles away)so I got a restraining order(to keep the kids here untill final hearing) and filed for change of custody. My question is how much teeth is the relocation restriction going to have in the Judge's eyes? We go to court very soon.

Here's the deal. The relocation restriction is not actually that big of a deal. What IS a big deal - and what you need to focus on - is that the kids are involved in the community. YOU are involved in the kids' lives. The kids have extended family in the area who are involved in the children's lives. Make Mom prove it's in their best interests to move. YOU just have to prove that YOU are a competent custodian and that the kids would be safe and taken care of with you.

I will have no problem proving that I am a competent custodian and the kids will be safe and well taken care of(she admited all of the above in her deposition). I am very involved with anything that has to do with my kids as is my mom and dad(I know they are not as important as I am but they are to the kids).Thanks to everyone here I may be able get get some sleep this week-end (have not had a more that 3-4 hours a night since sep.9 2008).
