Garnished again for SAME after it was satisfied!!

What is the name of your state (only U.S. law)? Georgia

I had a Garnishment that was satisfied. Because the paralegal did not send the papers to me certified, the court made them refile. That being said, they did collect the money IN FULL from my bank account. However, when they refiled, they froze my bank accounts again, which made auto payments go back to the creditors (Health Insurance, Car Insurance, Car Payment).

I am now being told by the Atty that handled the Garnishment incorrectly, that I am now responsible for the additional monies owed due to the additional time (even though it was their error?!?!?). They have taken every penny from my account this time that I had, which wasn't a lot. When they first took the money, they left me with about $1000.00, and I told him if I still owed back at that time, why did they not take that, and that is when he told me the additional money I am owing now is from additional interest due to their error.

Do I have any recourse? Can I go after them for what they are doing now? Do they owe me for the money they have taken from me and any additional fees that have come out due to NSF, etc? They are leaving me with absolutely nothing. They have frozen both my checking and my savings for the identical amount of money so I can not get a dime!

Among other things to do, file a complaint with the State Bar of Georgia (if the bad attorney is in your state).

Your debt was apparently fully satisfied once paid in full. Did you go back to the original court again and complain that they compounded their first error with an even worse error and that the court needs to order them to correct everything and do it right this time?

Of course you can go after them. Sue the bad attorney.

He is in my state. I did contact an attorney since I found out due to this huge error (for lack of a better word), my health insurance was cancelled and I can't get it reinstated. I need that almost more than I need food! He (my atty) said we will now go after them for a life care plan at the absolute minimum. My medical per year, roughly speaking are approximately 400k!

The atty tried to just decrease the judgement and give me about 4K. I would not accept. I was then told interest was piling on the longer I took. I told him they didn't do what they should have done zo the only thing that they need to start worrying about are the attys fees from MY atty. I do not believe he thought I really had one. Surprise for him!


This is an absolute nightmare!!

I will file a complaint.
