In Michigan, I won a judgment against a roomate that owed me money. I had to proceed to garnish her wages. Her employer called me to inform me that she didn't want the paperwork and that she would pay me installment payments for her employee. I said I would want the payment in full. She then told me that my ex roomate's hours and wages were cut in half so I wouldn't get very much, if I were to recieve garnishment checks, etc. But yet my ex roomate can afford to pay rent, pay for college etc. Sounds fishy. Is there any way to prove that her employer is paying her under the table of just plain lying about her wage and hour cut?

Since the landlord has already offered to pay you ("she would pay me installment payments for her employee"), I don't understand your apparent concern on whether the money comes directly from garnishment or the employer.

Isn't just getting the money enough?? Especially considering that by insisting on garishment it will apparently take much longer to get your funds.

In any case, if you don't believe the employer, you can certainly haul him/her into court to testify under oath as to the hours.

Finally, the fact that the debtor can afford to pay rent, college, etc. has little or no bearing on your collecting your garnishment. Most states provide exemptions to allow for 'cost of living'.
