I am in Kansas. Recently my mother's bank account was garnished. The only money in her account was social security and a small annuity pension from a life insurance policy. I tried to request a hearing for her to show that the money was exempt from garnishment, but was past the 10 days allowed to file for the hearing. My question is "can I still file for a hearing in court, or small claims court to try to get the money back?" Or what other recourse might we take to get her money back? Thank you for any help.
