This issue involves a home in Florida.
I'm sure this has come up on the forums before, but forgive me for not doing a diligent search yet. An officer was over at our home this July 4th and I really want to get this addressed quickly...
I'll 'try' and be short with the story, even though there is a lot of background.
My wife's brother has been in our home now for about 5 1/2 months. Never to pay rent or under any obligation to help us with bills. We took him in when he was severely depressed and got him psychiatric help, etc. When he snapped out of the depression about 7 weeks ago he turned into a disrespectful, rude, partying, monster. (Basically if you know about bipolar disorders - he's the text book case). We've repeatedly told him that if he wants to stay in our home he needs to live differently. All he had to do was pick up a simple 9-5 job and we would even help him with school and he can live her for free. With 'many a curse', he's told us off and that we can't tell him how to live (even though it will be my wife in tears again when she has to help him when he crashes again.) The Bottom line is we are done talking and we told him he needs to leave (won't get a job, disrespects his sister and I, the list goes on). For the past two weeks he's said he'll have his stuff out, but I know there is no way he'll leave on his own (even though he said he'd be out on June 16th). Today we got into a verbal fight because the neighbor got into an altercation with him since he was speeding (like he always does) down our quiet residential street where kids play and I confronted him about it. I told him to please have your stuff out of here at which point he got all smart and laughed and said "You can't kick me out, I live here, I'll call the cops right now and prove it." And so he did.
The officer basically told me I have to go through the courts now to get him out after giving him a 30 day eviction notice? I'm actually a bit in fear for my own life now as I think this kid is really unstable and as if my own life isn't enough to worry about, now I have to worry about my home being damaged while we aren't home. Do I really need to wait 30 days? Does getting the eviction notice take long to get and serve? Do I need to get an officer to serve him? Is there anyway to get him out sooner than 30 days? What happens after 30 days and he's still here?
