Gender-Bathroom Issue

I live in Missouri and work for a very large retailer. The store has recently hired a cross-dressing male who has not had the sex change operation nor does anyone know when or if that will take place. The store manager had a meeting where he told a number of employees (or perhaps it was dept. supervisors) that anyone heard talking about this man would be fired on the spot. The mere fact that this was said only fuels the rumor mill. This man has not started work as of yet.

In any event, a number of people (including myself) feel that this person should use the men's room until he does have the surgery (provided that is his plan). Another co-worker has witnessed this man (as a customer) in the store previously using the public women's restroom. I don't know if this happened only once or if it's happened on a regular basis, but I can bet money that it's only a matter of time before a customer would complain about this if they saw this person in there (he very obviously has a man's face).

Since when is cross-dressing or cross-gender considered a "protected class"? I believe that if this man is allowed to use the public women's restroom, that the store is going to have a lot more to worry about than mere gossip. It appears that they would be making the majority of associates (and customers) very uncomfortable just to make one comfortable if they allow him to do this.

You live in one of nine states that treats discrimination against transgendered individuals as a hate crime, punishable as a felony.

Missouri also allows transgender individuals protection under it anti-dicrimination laws.

So, tread lightly.

So there is no privacy violation in regard to the bathroom issue? I can't imagine the men thinking it was OK for a female to use the men's room.

Marcia, or Mitsy, or whatever else you choose to call yourself, you received the correct, legal answer in great length on the other board where you posted it. I realize that the answer you are getting is not the one you want to hear, but it is the correct legal answer nonetheless. However much you are bothered by his not using the men's restroom, you are going to have to put up with it. The answer is not going to change no matter how many times you ask it.

Surely you close the door while in the bathroom? So unless someone is laying on the ground looking underneath into your stall- what do you have to worry about? What about Unisex bathrooms?

Do the customers in your store complain about the women who bring their sons into the ladies room with them?

What about the occasional person whose gender cannot be determined by looking at its fully clothed body? Do customers come out and complain that a “marginal” looking individual was in the ladies room? Do they insist that someone go in and challenge the individual to prove her gender? Are most of your customers phobic or is it really only YOU?

I worked for three years with an individual who everyone assumed was actually a man passing himself off as a female. We never found out if she was born a female, became a female, or was in fact, a male. Out of 300 employees, I don’t know of anyone who felt anything but sympathy and compassion for her and I can assure you that no one ever begrudged her the use of the ladies room.

Well, that depends on how the hormone treatments are progressing. might have to be two or three fell swoops ;)
