Gender Discrimination??

I have a situation where I work and I am not sure what to call it. Here’s the story… Last April our company hired a new General Manager. Between April & July I had occasion to be in contact with him only 3 or 4 times (we work in separate buildings at the same location). I noticed several times that he cracked a few borderline jokes and he had a tendency to make comments to various people, myself included, that could be interpreted as derogatory. I chose to let it pass in the interest of him being new and still getting a “feel” for who would laugh at what. (He is a very insecure person who tries to be the BIG man to feel important[my personal opinion])

In July we were open late for wheat harvest and he was over on our side of the road. It was a slack time for the high school girl working with me and we had just finished a pizza feed with other employees working late also. The Manager said to me as I was walking past him “bitch”. I continued past then turned around and said to him “What did you say to me?!” His reply was, “My foot itched” (laughing). I told him that damn sure better have been what he said. The high school girl asked me later if she heard what she thought she heard. I asked her what she heard and she heard ‘bitch’

The next morning I reported it to my immediate Supervisor and made the decision (probably the wrong one in hindsight) to let the matter drop. Since that time, I make myself very busy whenever he comes to our side of the road—only speaking when spoken to and leaving the area if he starts telling one of his ‘stories’.

In September I was due for my annual review. My rather ineffectual Supervisor finally got around to the performance review in December. It was then that I was told I would not be receiving a raise at that time because the Manager said I have a bad attitude. I work for two Location Managers and neither one of them has any complaint about my job performance or attitude. I do all that required of me by my job description and very often take on other work without being asked. My work is accurate, timely and complete and I have never had any of my customers complain. There are several people who work for this company, including my immediate Supervisor that have exhibited really lousy attitudes and even worse customer service but I know for a fact that after recent performance reviews, they received a raises. (They are all male)

So, what do you think? Have I been a victim of something legal-wise? I really don’t know other than I feel like I have been royally shafted. I am attaching my reply to be turned in with my review to the General Manager next week. Do I have any recourse and if so what direction do I go?

On the one hand, there is absolutely no law requiring the performance appraisals be done on time (or at all - they are not mandated) or that anyone ever be given a raise.

On the other hand, it's just possible that you might have the beginnings of a gender discrimination case. All you have to go on, though, is that you didn't get a raise and several males did. That's not enough for a case on its own. It might be enough to begin building a case.

Call the EEOC, describe the situation to them, and see what they say.
