What is the name of your state (only U.S. law)? CO
I am an employee with the State of Colorado. I work in a male dominated field. Our office covers about 1/3 of the state and has about 45 employees. Six are women. Of those three are strictly admin support staff. Of the technical staff, there is 1 person who works in the field and she is and has been entry level for 5 years. I work in the office in a techinical position. In order to advance, I must take a field position. There are no opportunities to advance inside.

I have been there for 12 years, and I got mylast promotion 10 years ago. I was the last woman to receive a promotion to a new position. Two others recveived promotions up to grade level after training. They have this little game they are playing where, you cannot get promoted unless you are already working in the fielde, and they just don't hire women to work in the fielde. It is not a stated policy, or job requirement. Just one guy's rules. And he always says who gets a promotion. I have a M.S. in an Engineering Field. I am the only person in my office with a M.S. I have 12 years enforcing the same regulations I would be expected to. I have never received a performance evaluation that was not outstanding. I am an excellent employee. I enjoy my job, but I have watched other women apply for these positions and just get humiliated. I am tired of watching it. And I want a promotion. They are going to have to be very creative to find a way to say these guys out qualify me.

The 2 positions I have applied for require experience designing databases (according to the job descrption), I have developed every database we currently use in this office. I know the two men they have selected do not have any experience with either databases or spreadsheets. They have delayed for almost a year in filling the positions, because the men they have selected for the positions did not have enough experience (time) to qualify for the position level. They posted the position for Expressions of Interest to current DNR employees. Got 4 qualified candidates, but delayed until one droppped out. According to policy, if there are 3 or more qualified applicants who express interest, they are supposed to choose from those. But their choices were not qualified at that time, so they delayed and convinced one person to drop out. That way they could lower the position level to a grade where their choices could apply after the delay. They needed one year in a position 1 level below me to qualify for a position at my level. These guys have been filling in part time for a yar, so they decided that counts. THey are supposed to have 5 years total time in, but mneither one does. I don't know how they got around that, but they did.

At this point this would be a lateral transfer for me, with a promise of a promotion after training. I don't know if I even want these jobs anymore, I won't get them anyway, but I'm so damned mad I wont stop. I am going to make them work to move a guy three levels around me.

My question is, if after all this they give both positions to men who have less seniority, less experience, less education and have never designed a database or a spreadsheet do I have a case for discrimination? After manipulating the system in the way they have to avoid having to hire me?

I'm also 55 years old, they are about 25. Age discrimination? I have talked to the Union. THe said keep on doing the best I can to make it hard to eliminate me except by discrimination. They have to actually kick me to the curb before I have a case.

No one here can say you definitely do, or definitely don't, have a valid discrimination claim. We would have to see more information about ALL the candidates - and I doubt that you have all the information we would need, either. Not unless you've seen their applications and their resumes.

However, if you believe that the sole reason you have not been promoted is due to either your gender or your age, or both, you are free to file with the EEOC.
