What is the name of your state? West Virginia

General questions: We recently enrolled our daughter in a cosmetology school. While the contract specifically states refund policy etc... The day after submitting the enrollment application and a significant deposit towards tution - the local news reported that the owner of the school was indicted by a federal grand jury on five counts of fraud (financial reports), in relation to obtaining - designated as eligible financial aid status for potential students.

We are not seeking financial aid. However, we do not know our risk if the charges are found to be justified. What is the viability of the schools future? We do not know of contigency plans for the school to remain operational etc... Unfortunately, in our area this field of study is limited, and alternate educational sources are therefore limited. Would we be better off cancelling the contract, less the application fee and waiting for the outcome? If sometime during the 64 week course, the school was forced to close, would we have a legal position in obtaining a refund of fees, beyound a prorated schedule?

Since the owner was just indicted, doesn't it seem like a good idea to hold off giving this guy any more money until everything settles down? If the school did close, do you think that there would be money to refund your fees, even on a prorated basis? Further, you will be partway done with a program -- can you even transfer in to another program? If you have to start all over somewhere else, why not just start there to begin with?

thanks - that is what we thought also. Unfortunately, other school alternatives do not really exist in this area. We will just have to request a refund of what we can get now and wait. Since our daughter is "set" on this field, it may be that we will just send her to where another school is available and pay living expenses. At least it would not be money lost. In the meantime, my spouse has contacted the attorney generals office.
