In the state of Georgia, in an emergency situation, how long can DEFACS (Department of Family and Children’s Services) hold a child in a temporary custody home before holding a court hearing, (they have given the mother visitation rights only) And, what civil rights of the mother and child would be in violation of no court order has been obtained over a period of 24 days,as of now. DEFACS say they are waiting on OK from Sheriff and can not release child until that time. Sheriff Department says they are not doing investigation, mother was not in the wrong and it is up to DEFACS. No Sheriff or DEFACS workers have questioned any of the mother’s family members, co-workers, neighbors or previous baby-sitters about the mother.
