What is the name of your state Ohio
i was evicted on the 19th of this month. we were given until the20th @ 5pm to move out. W still have property in the apartment and the landlord came and changed the locks while we were moving. Can she do that? I thought she had to go to the sheriffs dep. and they had to post a notice before she can do that.How do i get my property back? I could really use some advice ASAP.

Have you called Law Enforcement to assist while you retrieve your belongings and make the LL let you regain entry ?

Thats the next step but i wanted to be sure that i knew what the law was before i called the LL and asked for permission to reenter the property.

Ohio Tenant-Landlord Law

While you were moving and the LL was changing the locks ,why didn't you call the Law then .

If the LL isn't compliant with the eviction process ,you DO-NOT ask for permission to retrieve your belongings ,you DEMAND it , or state you will have no choice but to have a Law Officer assist you .

we were unloading @ our new place when she came and changed the locks while we were gone. We contacted the sheriffs dept. and they contacted her and she said its a civil matter and we need to contact her attorney to find out how we get our property back. The sheriffs dept. said they only get involved if its a criminal matter.

You should contact the LL and demand you be let back in , if only to retrieve your property .

Inform the landlord you know your rights , and will file a claim for damages and attorney fees .

If the LL will not oblige ,

You need to consult an Attorney , then in your counter claim request attorney fees and property damages.

LOCKOUTS & UTILITY SHUTOFFS
The landlord may not move a tenant's furniture from the apartment, lock a tenant out or threaten any move. The landlord can only evict after a court hearing and with a lawful court order, or the landlord risks liability to the tenant for all damages and reasonable attorney fees. Even after a legal eviction, the landlord has no right to keep the tenant's property.

Usually if the Court rules in the landlord's favor at the original hearing and the tenant is not off the property within ten days, then the Court authorizes a bailiff or sheriff to remove the tenant's possessions or furnishings from the apartment onto the street.

There is always strict laws governing eviction, in no case can someone demand u move in one day.

You should be able to get your property or the price of it as well as punitive damages.

Check out your state laws on eviction and illegal eviction then sue her for the maximun amount due (even if u were behind in rent she must follow the law).

This is probibly small claims court material...file a case in local courthouse. its fun to get them supenaed
