Getting back a security deposit

We rented an apartment for 2 and a half years in Florida.
We signed a years lease. After the lease was up, we rented
month to month. We had a very good relationship with the
landlord. When we decided to move, we called him to inform him of this and gave him 30 days notice. We also sent him a letter to protect ourselves legally. When we moved in, we paid first, last and security. When we did the walk through, he said he was keeping our deposit to replace the carpet because it was stained. With the exception of normal wear and tear, the carpet was fine. The landlord never sent us a 15 day letter regarding the deposit. We have sent him numerous letters, including a certified letter. He refused the certified letter. We paid our last months rent in November and moved into our new apartment on December 1st.
When we turned in our keys, the landlord informed us he was keeping our last months rent for the month of December. Is there anything we can do? What are our rights? Can he legally do this? If we take him to court, do we have a legal leg to stand on? PLEASE HELP!!

You should a taken picture of the carpet to show the judge... oh well

sue him for your securtiy back, and he will have to prove to a judge that he actually BOUGHT new carpet for him to keep the deposit, and since he knew you were moving out he has a duty to mitigate damages like to re rent asap...

You have good proof he refused a certified letter, he has not given you anything in wrting about the damages and itemized them..which is ilegal

so make him prove he put ads in the newspaper and showed the apartment...which he didnt..so he is responsible for decembers rent... not you

you should get get the 2 months back...the landlord is anasssshole.......but YOU have LEARN about our legal system and learn when you get ripped off how to defend yourself..

not just whine and complain here.......go for it!
