ok here we go again lol. Have a question and hope i can get some answers.
My fiance has 5 kids with his ex-wife and she gets welfare and support and her bills get paid for her, kinda screwy i think, she does not work and refuses to get a job saying its her right to stay home and raise the children.
well now, the judge awarded her sole custody of the 5 and is having him pay out 60% of his take home pay. And they want him to get a second job so they can take more money.
Is there anyway of having the courts rehear his plea of getting joint physical custody? that way he will be able to bond with the children and they with him and thier baby sister that is hear.
That would also force her to get off her butt and get a job as well. that isnt why he wants joint but its a bonus.
they live in a different county then we do but here is what he originally asked for. 6 mos here and 6 mos there. he could have them for the 3 mo. summer and first 3 mos of school in which time they will be transfered to thier mothers house. it would also give them a chance to make friends in our area(something they dont have now)
I think its a good idea that way for at least 6 mos the ex will have to have a job so as to be able to pay support as well and she will be able to realize that its a lot harder to live off of something you dont have. and he will be able to be a productive part of the childrens lives instead of just a financial part. thats all he really gets now anyway.
Is there a chance to have his plea reheard if we get a change of venue and a new judge?????
Please help us he is drowning in depression because of the pain this is causing.
