I'm getting a divorce after only one year of marrige. I've still been claiming my self as single for the past year. Do I file single, as married, or married and not claim my husband. He didn't work much the past year. Can he come back later and want a portion of my refund?
I would appreciate any information you have. I'm already to file for this year. I live in the
State of California.

Unless you lived separately for the last six months of the tax year under a legal separation, you'll have to file as married. If your income was at all sizeable, you'd be far ahead if you could work something out with your spouse to file jointly. Absent that, you will have to file married filing separately which is the worst of all filing statuses.

The above is for federal taxes. I'm not the least familiar with CA state tax.
