We looked at an apartment, we gave the lady the first months rent and was told to pay her the deposit when we moved in. She gave a paper saying this. later while visiting the place her daughter said she really didn't want to rent to us. When I called to tell her we would not be moving in, she said she was keeping this money. Does she have any legal right to do this? This is Wisconsin.

YES because her daughter has NO legal right to tell you not to move in..

And technically YOU violated the lease........BUT

If go there now today tonight, with the ALL the money for the deposit.. and get the keys...if she refuses to sign a lease or return your money, then you tell her you will sue her in small claims court on TUESDAY for refusing to honor your agreement.
