getting my 401k money after being fired

Ohio:

I was fired in '05, in '04 my employer changed from Ohio National to Union Central for their 401k. I had all of my funds in a "cash" account. I was told I could not transfer all of my funds from Ohio National to Union Central because the money was in the cash fund.

Some of the funds were eventually transferred to Union Central. I was fired in '05 and my ex-employer is still telling me I can't have the 15k remaining in Ohio National. I was fully vested having worked for over 20 years at the same company.

My H&R tax advisor says something is definately wrong. I should be able to get my money.

The question is: since I was discharged, can Ohio national keep my funds?

If not, what is the best method of contacting the three parties to get my money transferred to another 401k?

Ask the employer for a copy of the 401(k) Plan Document and see what it says regarding the withdrawal of funds after termination. 401(k) plans are designed to be portable (i.e. can be withdrawn or transferred after employment ends) so I don't understand your employer's position at all.

If it appears the employer is in violation of their Plan Document, contact the federal Department of Labor and file a complaint
