getting my car back

Marysville, wa. My wife and I have been split up for about a year now and I recently let her use my car in exchange she would split custody for my five yr old with me and not persue child support. She has now refused to let me see my daughter and filed for child support. I have an extra key and plan on going to get my car back without notifying her. It is only in my name so if I take it and she calls the cops is there anything I can go to jail for?

You cannot go to jail for it, but you can seriously get your butt handed to you in a divorce court...particularly if you have another vehicle to drive. If the car was purchased during the marriage its marital property. If its marital property she can take it right back from you again without going to jail either.

Don't play these kinds of games. Your solution to your problem is filing for divorce and pinning down custody/parenting time/child support.

Perfect thank u. By the time a divorce goes through it wont be in my name. And yes I had to go purchase a car bc I let her use mine bc I thot if I did that she would let me see my daughter. So now I have a car payment can't see my daughter and am paying child support for my kid I can't even see she has cleaned out my bank accounts and I did not know she got ahold of some mail got access to my account took 200 which she no longer obviously has access to. and I have given her money to go pay for a divorce that she spent on other stuff. She wont give me my w2s so I can do my taxes I have to go hunt for new ones and we are only in this situation bc she cheated on me with my best friend while I was gone for 2 yrs bc im in the military. So getting my butt handed to me in divorce court is the least of my worries. Just wanted to make sure I wasn't goin to jail.

My gf told me about this and said I should find out about goin to jail or not so I did. This is what she used to find out about a parenting plan.

I am sorry, but I think that you are on the verge of making a huge mistake. Right now, she would look like the bad guy in court for denying you any access to your mutual child. If you do what you are planning on doing, then you BOTH will look bad to the judge and you will lose all leverage from mom being the "bad guy".
