My husband and I own an underground sprinkler business in Indiana. Last year, we were hired under contract by a large construction firm based out of Virginia to install a sprinkler system for a HUD improvement project at one of our local public housing complexes. We received 50% down, and are to receive the rest upon completion of the installation. Our original contract included installation of a private well to feed the system, however, due to the close proximaty of the complex to a heavilly used railroad, a driven well was impossible. We attempted to drive the well, and ran into something very hard at about 40 feet down. The well would drive no further, so we offered to deduct the amount of the well from thier balance due, and it would be up to them to have a well installed, at no resposibility to us. They accepted, and removed the well installation from our contract. The sprinkler system is now fully installed, and balance is due. They still have not had a well installed, and refuse to pay us the rest of our money ($11,500.00), and the reason they give is that they shouldn't have to pay until they see the sprinklers run. Do we have to wait around for them to install a well? What if they wait for a year?? We can't turn the dumb thing on without a water source, and the complex owner refuses a city water hookup. What can we do?
