Getting rid of a stubborn roommate

I live in the Sacramento, CA area. One of my roommates and I are trying to get rid of another roommate, but he is claiming we can not kick him out and although he's planning on leaving he will leave on his own schedule. He consistently pays his rent anywhere from 3 to 15 days late and we have been threatened with eviction twice. The apartment manager says unfortunately they can't kick just him out because we are all on the lease.

What can we do to get him out? Is there a certain amount of notice we have to give him? Is the apartment manager wrong? She wants him out just as much as we do because he has been an ongoing problem, but doesn't think she can without evicting all of us at once.

Managers correct. One goes you all go.

However, you can get evicted and actually move out furniture etc. temporarily. Couple of days maybe. Then move back in under your own new lease.

All parties, you, the other roommate and manager must agree to new lease terms except the person who everyone really wants out. New lease would be needed to avoid legal actions by unwanted party. He should NOT be told of the ploy...:D

Get everything in writting prior to signing new lease agreement.

Thanks for the response. My roommate and I had thought of that, but doesn't that also put a bad mark on our rental history, or is that up to the apt. manager?

As I stated prior, get it ALL in writing prior to signing the agreement.

If your planning on being renters you entire life, either at the current location or any where else, the discredit could detrack from your rental history true, especially if it is not in writing, to be excluded by the manager.

If you plan to purchase a home, condo, etc. in the future, it's a MUST item in the agreement between you and the manager.
