Very true. The apartment has been smoked through and I'm getting all kind of respiratory problems, ailments, and headaches.

Now, I don't wan't to actually sue (but if I can and have to I will), as I've got more important and urgent things to do, but I do want to get the hell as fast as I can out of here and do want to have this trump card up my sleeve so that I will get reimbursed for all the expenses that I incurred as a result of this awful move. Thank you.

If you mean your Apt. fills with smoke or smoke odor and there is no clause about No Smoking in the building in your rental agreement , you do not have a trump card ,and you will not be reimbursed expenses.

Kindly ask the LL to release you from the lease because of health issues in writing.

Otherwise be more more specific about how your apartment is smoked through.

So, you don't want to, but if you have to, you'll be happy to sue in anticipation of a big payday from the landlord.

What do you mean "smoked through?" Is there a law in your building about tenants who smoke? How is the smoke getting into your apartment? Do you have proof through a doctor that the smoke is causing your problems?

Since, in your previous posting you claim the former tenant smoked quite a bit while in the bathroom, try washing the bathroom walls down with a mixture of water and TSP (found in big box home improvement stores).
