My husband has a 5 year old from an ex girlfriend. We pay her child support, but there has never been an order for it.Recently, we have decided that we need to go to court because she has recently denied us to see the child.They have never been to court..She apparently applied for government aid in NC, therefore, their child support enforcment has contacted us demanding child support.It really isnt that big of a deal because we already pay her and it will just be documented now.My question is..how do we begin the process of getting a visitation order? Is this something that we can do ourselves? how would i find out about forms...
we are moving to NC at the end of the year to be closer to her..any help is appreciated..

I hope you keep all the receipts for the money you give for child support. I know that my husband got hit with paying back welfare and medicaid even tho he paid the support and proved medical coverage. http://www.rosen.com/childsupport.htm this is the web site for child support in NC. That is where it will be granted at since the child reside in NC. I am not in the legal field but this is just from my husbands experience with ex getting welfare, childsupport and a medicaid card.

they could make him pay back support even though there wasnt a court order? How would they know what to base it on? how would they even be able to calculate it?

Husband and I are still trying to figure it out. He is paying 250.00/month for every month she and the kids were on medicaid and she refused to use his insurance. They take all the child support a month but give the CP 50.00 of it. I would might want to get legal advise. Our lawyer could only have child support say what they thought he paid and then went from there. There is something wrong with it since she collected both at the same time.
