What is the name of your state (only U.S. law)? Wisconsin We would like to gift $200000 property to our 2 children and spouses. We welcome any comments on the following two options: Gifting or Selling and Gifting the amount owed. How would their basis be calculated? Thanks.....

Do you plan to give them this property before or after you're both dead?

You both have a 100k basis in the property. Give each of the four a 12.5k interest, from each of you for xmas. On New Years day, give them each a 12.5k interest. Presto!!!

Hopefully these are ADULT children. Gifting property to minors is problematic. Think carefully before you do this. The minor is not able to convey property on their own (and neither can their parents). You'll end up creating a liability in taxes and other issues that they can't dispose of without legal intervention.

Unless you are selling the property for FMV, the transfer is a gift at the FMV. If the value is over $13,000 you will have to file a gift tax return. You won't owe any tax unless the value of this (and any other prior gifts you have made) is in the millions. As pointed out, they will get your low basis (what you paid for it) rather than the value at transfer. This will determine their capital gain when they sell it.

Note that you should only consider this if you have sufficient other resources that you will not need this property for anything else. You can screw your medicaid eligibility if you dump assets in certain circumstances.

A property that is gifted takes the basis of the grifter. A property that is inherited takes the FMV at death or alternate valuation date.

Why are you gifting it? Let them inherit. But, rather than me write up all the scenarios, why don'.t you give your goals.

Gifting property to your child is not always in your children's best interest. Explain more thoroughly what property you want to gift, and why, and you will get better answers. Gifting property to both your children and their spouses can end up being problematic as well.
