I have known this girl for about 2 months....She got pregnant and we talked about abortion....She had agreed, but now has changed her mind.....I have a stong feeling that it isn't mine...
I would like to have a test done to see if it is mine,but I do not want to wait till the baby is born....I have heard that once your name shows up on the birth certificate it doesn't matter if the test later shows your not the father, that I would still be responsible for the child....
She doesn't want to get a test done........I personally don't have a lot of money, but my parents are upper middle class....They helped me buy a house which is under mine and their names...
What can I do now to protect myself if she doesn't want to have the test done...

After the child is born do not sign any papers acknowleging paternity, and file a petition establishing paternity. There is nothing you can do until after the birth of the child.

In California, if you are not married your name cannot go on the birth certificate as the father unless you both sign a declaration of paternity and or petition to establish paternity with a DNA test. If you sign the Declaratin of Paternity and/or have a positive DNA test, the court can order you to pay child support and you can petition the court for other rights, custody, visitation.

What are your intentions towards this woman if your are or not the father? The fact that she doesn't want a DNA test can be telling but this is usually done after the birth of the child for paternity, although it can be done during CVS and/or Amnio if there is a medical reason. You may ask that if there is reason to have an ultrasound,that they date the pregnancy, which will tell at an early stage the approximate age of the pregnancy in terms of weeks and days past her last period, not the date of conception which takes place about 2 weeks later +/- 5 days this early, this can give you an idea if she was already pregnant when you met and might give you some idea how to proceed.

In California the age limitation for paternity action by parent is 18 the age of majority in California. A Declaration of Paternity which may be completed by age 2 and may be recinded within 60 days of filing the Declaration of Paternity or the 18th birthday of minor parents. The Declaration of Paternity may also be recinded by a DNA test disproving biological paternity, however, a court may still rule continue the rights and obligations of the presumed/legal father if it is in the best interest of the child. Once the kid is born have the test is done. If the test proves your not the father then you are not responisable for the kid, you wouldn't have to pay child support unless the test proves you are the father.

Prenatal DNA tests are dangerous for the child. You won't find a doctor who will do the test unless amnio is needed for a valid medical reason. You will have to wait until the baby is born.
