I'm going to keep this short.
I'm 25, ive never been in a car wreck, at the time of the accident i didn't have insurance, yes i know it was stupid. My girlfriend has full coverage, everything on her car.
My girlfriend was driving my car(with me in passenger seat) down the interstate. There was a 2014 charger in front of us(not overly close). Someone cut the challenger off(driver admitted to police) and he slammed on his breaks, she slammed on mine but didnt have the reaction time. Florida is a no fault state. She was ticketed on site for following to close.
I understand my car is at fault. The BBK on my car is about $8,000. My insurance is covering the Challenger($7000) in damage and the older couples injuries since i do have that. My insurance is saying that since i dont have collision that they (understandably) won't fix it. Her insurance is saying that even though she is at fault, to have my insurance fix them and they'll assist.
My car has since been fixed out of pocket by me($3000). I have pictures of everything, the car would of been totaled for sure. I paid $0 in labor, im very mechanically skilled and have a lot of car friends and sourced a lot of parts from junkyards.
Then a month after this happened, my insurance sent me a bill for $1xx. I asked why and they said that in order for them to cover the challenger and the couple that she needed to be on my policy. So they added her to my policy and back dated in 35 days(which is to the day of the wreck) and put her on my policy from that day. The $1xx bill was for the 35 days she was on my policy. I paid it of course. So legally and technically she was on my policy when the accident happened. One of the first questions we both got asked by our insurance companies was if we had any other insurance, we both said no since neither of us were on each other policies, though technically since my insurance back dated my policy...she was.
Is there anyway that if i get a lawyer i might be able to get some money out of her insurance? Or am i 100% at a loss?
