I purchased a television in a common large electronics store. I researched online and asked for a specific model number which the attendant plugged into their machine and then went to the back and picked up. They then brought it out front for me and loaded the car. Only problem? When I got home and unpacked everything I realized it was the wrong model. It wasn't simply a problem if they gave me the wrong one by accident, it was that they have been stocking this one (the previous year model) as the one I wanted and purchased. When I confronted them they said there's nothing they did wrong since they followed their policy, but that they can refund me. The biggest problem I have is that I know they sold at least 3 others of this same tv earlier in the day, almost certainly all with the same issue as me. There are also comments on their online site saying that they tried to give other customers the incorrect tv (same one I ended up receiving as well). I'm interested in what I can do as well as what law that officially is against. Is it false advertising, fraud, etc.?

What you can do is accept your refund and go buy the model you want somewhere else.

That's it. That's all. Nothing else.

You don't get another nickel beyond the refund.

By the way, the TV comes in a nice big box with the model number appearing in numerous places on the box.

All you had to do is look at the box and you'd have seen that the model number didn't match what you wanted.

This isn't the store's fault. It's yours.

As AJ said, you're not entitled to anything else. If you think it was an intentional bait and switch you can alert the authorities (Since you decided to blow off the question as to your location, we can't tell you which agency to contact). They will sanction the retailer, but you're not getting anything more out of it.

I'm not trying to nickel and dime them. I'm a little bummed about a particular feature this one is missing but otherwise the tv is still a good deal. I was just wondering about the things I asked because I've never had this happen before (I've bought the wrong thing but never been given the wrong thing). It's not even that which confused me, but the fact that the store has been marketing this as a product it is not. They advertised on their website and in store for a product they don't have and sell you that one then give you a different one. If it's on me to check the model number on the box (which I believe it is) then isn't it on them as well to know what they have and recieve and sell?
