What is the name of your state?I live in the state of California. I have already filed my claim and court date has been given. Now I am ready to give the defendants orders to go to small claims court. When I filed my complaint, the defendant is a corportion DBA with two individual names. Do I have to serve three seperate orders to go to court or just one? I filed online and when I made my copy the courts sent back to me it has listed on form sc-100 as the defendant corporation dba individual and dba individual name. Now I'm filling out form sc-104 and at the top it asks for party or defendant. Is this where I fill in the defendants name, address and phone number. Thank you.

You should re-state your question AND make it a little less confusing. No one outside of California and probably few within California are going to know what you're talking about when you refer to court form numbers. You're expecting too much, if you expect homework to be done for you.

Beyond that, to my reading, you imply that the court told you how to designate and serve your defendant(s)? Courts don't do that, so tell us what's going on.

Corporations can have dbas and people can have dbas. Are you trying to sue "Acme, Inc. dba Acme Goodies" or "John Macho dba Acme Goodies" and "Sally Sweetcheeks dba Acme Goodies". If the latter, name each one and his/her dba "individually, jointly and severally". Serve them exactly as they're named in the claim. It's hypothetically possible for a corporation to have two dbas and for each dba to be an individual name, but I'm guessing that's not what's happening (and I'm not even addressing the problem of real people with those same names).

Just a suggestion: if you're uncertain about this, have service done by the sheriff or a registered process server.
