What is the name of your state (only U.S. law)? VA

I've told my husband that we need to give our landlord notice tomorrow in order to live up our 60 day notice lease requirement. I think I have read here and elsewhere that notice must be given at the beginning of the month.

Our lease expires 12/31/09. He says we can give notice at anytime so long as it is 60 days. Which is correct? Please point to a specific law (if you can) since my husband is unlikely to believe some random person on the web. Thx.

If you are planning to end the lease on Dec.31 then you absolutely need to give your notice by Oct.31st.I strongly recommend you make it in writing and hand deliver it tomorrow.

The way our leases are written, if you mail it, and I receive it anytime in November, the 60 days will begin the first of December,making you liable for the rent through January 31,2010.

Oh...sorry...it is not relevant to any state law...it is under the dictates of your lease agreement.

Notices MUST be delivered ON OR BEFORE the next rental period.

MOST rental periods start on the first of the month, however LL's usually can choose WHEN the rental period starts. Some start on the 15th of the month.
