What is the name of your state (only U.S. law)? Washington

I'm asking for my SO. I will try to keep this short and to the point.

His ex-wife has legal custody of their two sons. The boys have actually been living with us for 4 years, but they never legally changed custody.
She entered drug rehab last weekend, and my SO feels under the circumstances now is the time to legally change custody.

I'm trying to figure out the best course of action. Emergency orders with motion to modify parenting plan? Or temporary orders? Or just the motion to modify?

What is your opinions? Thank you

It is NOT an emergency. He should just file to modify custody based on status quo.
