Going to court when I already have custody

What is the name of your state (only U.S. law)? Ohio

By default in the state of ohio I have custody of my children for being unmarried. The father would watch the children during my work hours. He provides no financial support for them and has no job. Every morning I have to call his father to wake him to get him to come out for the boys so I can go to work. He is consistently late. My job is in jeopardy. My son is also consistently late for school because of him. I need to get them a sitter or into daycare so I don't lose the only source of income for these boys and so my son is not affected by the many tardies and absences. Their father disagrees with this.

Their father makes no effort to see them outside my work schedule. On the many days I have had to call off because he didn't come out he never mentioned them at all. Now that I am at my breaking point and told him I'm finding new childcare he wants them. He said he wanted them every morning at 8am. He picked them up the first morning and no showed the second. He demanded my youngest(who is not in school yet) later that day and I refused, so he picked my son up from school and said he would not let me have him. He tells my son to fight me and not let me put him into daycare. He threatens that he is going to destroy my life. (physical violence played a large role in our separation)

I have sought out community aid for help but being that I have sole custody they will not do anything. Saying I have custody means nothing and I don't want to withhold the children from him. I just need a court to tell him what he is aloud to do and be held responsible for whatever schedule he agrees to. I feel getting something documented and being able to safely get them into a childcare program would be beneficial, but how do you go to court for custody issues if I have it already?

file to establish paternity. then request a parenting schedule for dad. look up parenting plans in your state. request child support. if dad's inability to stick to a schedule is interferring with your job, then you need to start looking for alternate methods of child care.

You file for custody, child support and parenting time for dad. You get a set schedule put into place.

The problem I see is that the status quo is that dad has them while you work. You may have to show some evidence to the judge (perhaps the school's record of your son's tardies) to help you demonstrate why its not working.
