Got a loading zone ticket while I was sitting in the car, any way to fight it?

In MA:

I got a loading zone citation while I was sitting in the car! It was a heavy raining day and my window was foggy. I tried to open door and moved around so the officer could see me, but instead she wrote up a ticket and slapped on my car window. Got out of the car and tried to tell her I was right there, but it didn't work.

My car parked there a total of about 10 minutes and dropped off and picked up passenger during that span. Any chance of fighting the ticket and win? I tried to have the ticket dismissed by my dismissal letter didn't work. Now it's at the stage of scheduling a hearing.

It doesn't matter if you were in the car or not. If it was a loading zone and the CAR was parked there illegally, then pay up ;)

That I know, but one could parking in loading zone and the legality of my ticket (or parking) is somewhat subject to interpretation as to what is actively loading/unloading passengers. Is it that only the 2 seconds when passengers enter/leave the car count towards the unloading/loading?

It just seems awefully invalid to make a law to require people not even temporarily parking (with driver present, waiting to pick up passenger) in an unused loading zone. What's the point of making driver circle around the block, creating driving harzard in the pouring rain, poluting air and wasting energy consumption while the loading zone sits empty? Now we all know there are some stupid laws, and this ought to be one of them if interpreted that way (only 2 seconds count). Then again, I guess the judge would probably use this interpretation.

I agree. Run for the legislature and get this changed.

**A: I disagree. The vehicle and driver should not be allowed to be in a loading zone period.

Wrong. Our local law says both commercial and passenger vehicle (and of course the driver) could be in the loading zone if it's actively loading/unloading, or in front of/within some feet of hospital/restaurant entrance under some conditions, even if it's loading zone. I doubt that any law would be so sweeping in prohibiting parking in loading zone.

Besides, my point is, it's a loading zone, not a no standing zone. What's the point of prohibiting drivers having car standing there waiting for loading of passenger? Even a commercial vehicle in loading zone won't be loading all the time.

How big is the fine? Is it worth your time? Which city did you get it in?

$55 in Boston (which is maximum, BTW. I remember it ranges from maybe $25 to up to $55 for my type of ticket). I feel that it's not really worth my time if I have to attend a hearing, but I hate to have to pay for a ticket that I truly feel I don't deserve. I mean, after all, you'd expect the officer to wave you away instead of giving you a ticket EVEN if you're obstructing something, and nobody's using the loading zone & I did not show any unwillingness to move if needed.

Yep, not worth your time, sorry. I had this once, and they just smile at you and say "you saw the sign, just pay the fine". Unless compelling reasons exist, Boston tickets are nearly impossible to dismiss or even reduce.
