Got scammed on ebay for $1800.00. How do I file?

What is the name of your state (only U.S. law)? MA.

I purchased an item for $1800.00 2 months ago.

The item did not fit and I returned it.

Delivery confirmation/signature etc.. everything.

I have e-mails of the seller stating he DID receive the item and will issue a refund.

Its been weeks now and he keeps saying "I'll issue a refund when I have some free time"

Those of you familiar with paypal , it takes 3 clicks to issue a refund. It can be completed within 3 minutes or less.

After weeks of this I'm starting to get nervous. I'm unfamiliar with the law and SOL.

He is based in a southern State.

What do I need to do to guard myself and if worse comes to worse, bring this to small claims court? Is it my State or his State this suit needs to be held in ?

You should not have let him string you along. File a complaint with paypal NOW. I suspect he kept delaying in order to go past the time limit for you to file a complaint. If that doesn't work, you should dispute the charge with your bank.

I would do that I'm just afraid that'll only piss him off and further delay the process.

I'm unsure of his actions but I do want to protect myself.

Then he won't issue a refund and it'll goto court which will take months and that $1800 will accrue a 17% interest rate on my credit card.

I'm torn between letting it go a few more days and pleading with him to issue it when he can or just taking it up with paypal.

I have everything saved, the USPS delivery confirmation page, the delivery date/time. I have his e-mails and text stating he did receive the motor , etc..

You're too trusting and it's about to cost you $1,800 if you don't act quickly. If he had intended to refund your money he would have done so by now. Like you said, it only takes a few clicks.

Let me make this clear to you. He has no intention of ever refunding your money.

Your only recourse is to file a paypal complaint and then if that does not work dispute the credit card charge. You might be over the time limit for option A. Call your credit card company to be sure you're not about to go over the limit for disputing the charge. If you're close, then don't even both with paypal and just dispute the charge with them. Paypal will get their money back from him.

I think it's too late already. PayPal claims must be filed within 45 days. Maybe that's why he's stringing you along. ??????

You should have filed a paypal dispute right away, and as mentioned if its been more than 45 days then you can't use that option.

Next option would be a credit card dispute. Don't waste anymore time, do it now.

After that, then your flying to their state to sue them in small claims court.
