GP custody in will?

What is the name of your state? Texas

I am mother/CP and I live with my mom & dad (the children's grandparents). I was mulling over the idea of making out a will in case something unexpected should happen to me. (I was informed that it is extremely important.) If I request in my will that my parents become the legal guardians to my children, can the father gain custody? Oh, and they have two different fathers, so I wouldn't want them to be split up and one go to X and one go to Y. Or is it inevitable that in the event of my death, they would each go to their separate fathers? Or can I mandate in my will that the children go to their grandparents?

My response:

Children are not personal property. You can't "Will" them away. They would each go to their respective, surviving, parent.

So, in order to avoid your worst fears, then don't die.

jk- c'mon, seriously- they can be split up? If so would they have rights to see each other? And I am not planning on dying but for the sake of a natural disaster, like hurricane Rita, or a fatal car crash, etc.

It is remotely possible that your parents could get visitation rights with the children and then the children can see each other.
This is an unfortunate pssibility when families split up.

A thread is "hot" after it has had a few replies. A Sr. member is a poster who has 1,000+ posts. I haven't the foggiest what the difference between a reg. and a Jr. member are.

A junior is up to 30 posts, I think. After that until 1000, you're a member.
